Requirements :

The Trade Officer should have good knowledge of the Malaysian
business environment and business/investment climate. He/she
should have a solid understanding on how to start up a
business in Malaysia. Furthermore, he/she must have good
understanding of local industry sectors and services. It is
a must for the trade officer to enjoy business intelligence.

The trade officer should be able to work independently. He/
she should both understand how to represent a government
agency and how to deal with companies. Pro-active and
service-minded attitude, presentation and conversation skills
are important.He/she should treat all projects information
with confidentiality.

At the same time, the new colleague should be a team player
who understands that assisting companies and trade promotion
is joint effort of the team and other involved parties
(Foreign Investment Office, Agricultural Department). The
trade officer reports to the Head of the Department. The
assistant trade officer is primarily responsible for helping
to provide and gather information and providing logistic
clerical support.

He/she should have an excellent command of English
(including writing). Good social and communication skills.
Minimum of 5 years working experience. Experience in trade
promotion and trade/investment consultancy is an advantage.
Good knowledge of internet and documentation based business
intelligence is a must.

Please find below information to delink FII investment in
certain cases in India.

The Indian Government has proposed extensive changes in the
guidelines for foreign direct investment (FDI) that could
impact a range of industries such as telecom,infrastructure,
real estate and broadcasting.

The changes include such measures as including investments
by non-resident entities in sectoral limits, removing
foreign institutional investment (FII) towards calculating
sectoral equity limits with caveats and withdrawing key
norms in Press Notes 3(1997) and 9 (1999) on 100 per cent
foreign holding companies and their downstream investments.

These proposals were part of a note prepared by the
commerce ministry and discussed by the Cabinet committee.
They are aimed at liberalising the FDI regime not only to
attract more foreign investment against the background of
a global liquidity crisis but to standardise procedures
across various sectors.

The relaxations will apply to those sectors that have
composite limits (FDI plus FII) and for which there are
no separate statutes or rules that specifically govern FDI.

If the new norms are cleared, companies will get six months
to comply. The note suggests that the changes be
implemented in phases.

The first phase, which was discussed recently, will
finalise methods for calculating direct and indirect
foreign equity in Indian companies.

This includes counting investments by non-resident
entities(non-resident Indians and Overseas Corporate
Bodies) directly in an Indian company as FDI. NRI
investments currently do not figure in the sectoral
FDI limits.

Streamlining FDI (Phase I)

* Investment by Indian companies in which foreign firms
  have beneficial investment will be counted as direct FDI

* Indirect foreign investment through an investing Indian
   company would not be considered for the calculation of
   foreign investment if the Indian company is 'owned' and
   controlled by resident Indian citizens

* Direct investments by non-resident entities to be
   counted as FDI

Phase II

* Investments by FIIs not to be counted towards sectoral
   equity cap

* Removal of Press Note 3 (1997) and Press Note 9 (1999)
   meant for 100% holding companies.

According to the proposed guidelines, if a company based
in India declares that a foreign firm has a "beneficial
interest" in it, any investment made by the Indian company
in another domestic firm will be considered FDI.

Indirect foreign investment through an investing company
would not be considered in calculating foreign investment
if it is controlled and owned by resident Indian citizens.
This will apply if 50 per cent of the company is "owned"
by a resident Indian citizen or the resident Indian has
the power to name a majority of board directors in the
company.

In the second phase the government will consider the issue
of excluding FII investment in calculating sectoral limits,
but a deadline has not been given. This adjustment has been
widely demanded by domestic and foreign investors.

The move will be a major plus for telecom companies many of
which are close to their 74 per cent equity FDI cap because
of FII investments.

Some exceptions, however, remain such as if the FIIs
choose to invest under the FDI scheme or when they submit
a declaration that they are acting in concert with any of
the companies that have invested in the Indian company.

To simplify procedures, the government has proposed
withdrawing Press Notes 3 and 9.

Press Note 3 of 1997 specifies that a foreign company will
have to secure Foreign Investment Promotion Board (FIPB)
approval to set up holding companies in India.

Press Note 9 of 1999 relaxed the conditions for setting up
holding companies and said foreign-owned Indian firms need
not take FIPB permission to make downstream investments in
sectors open to foreign investment.

The note said these notifications would lose their relevance
once the new norms for direct and indirect foreign equity
in an Indian company come into force.

Subject: Invitation for Prequalification of contractors for the
upgrading of the Dr. A.G. Jeetoo Hospital

The Ministry of Health and Quality of Life intends to
pre-qualify contractors for upgrading of Dr. A. G. Jeeto
Hospital. The project consists of the erection of new hospital
buildings, and the refurbishing of certain existing buildings.

The new hospital will comprise a total of 550 beds over
approximate GFA 30,700m2 measured areas. The new main building
comprises a semi basement, plus 4 floors, with a partial
mezzanine floor. It is in the form of 7 linked buildings around
an atrium. The main building links through an existing 3 storey
structure which consist of concrete framed with blockwork infil,
and will undergo extensive internal alteration and
refurbishment. It is expected that invitations for bid will be
made in January 2009.

Interested eligible applicants may collect and inspect the
prequalification document at the Public Body's address below as
from 0900 hours on working days. Alternatively a complete set
of the Prequalification Documents in English is available on
line at the following address: http://health.gov.mu

Applicants for prequalification should be submitted in sealed
envelopes, delivered to the address below by 20th November
2008 up to 13.30 hours (local time) at latest and be clearly
marked "Application to Pre-qualify for Upgrading of
Dr. A. G. Jeeto Hospital, Prequalification
No. MHPQ/N.MED/08-09/Q48".

Applications received after the prescribed closing date and
time will not be considered.

Consumers can expect duty-free imports of a range of products
like capital goods, some textiles, electronic goods and
chemicals from next year after India successfully concluded
negotiations on a Free Trade Agreement (FTA) for goods with
the 10-member Association of Southeast Asian Nations (ASEAN)
in Singapore.

The formal pact will be signed this December at the
India-Asean summit at Bangkok, which is expected to be
attended by Prime Minister Manmohan Singh.

The breakthrough comes after six years of negotiations for
the trade pact, which is expected to add $12 billion by 2010
to trade between the participating nations.

A Sneak-Peek at the Indo-Asean FTA

* Reduces tariffs to zero in over 4,000 goods out of 5,000
that are traded. To be done in a phased manner over six years

* Partial reduction in import tariffs on highly sensitive
farm goods. Tea, coffee - 45%, pepper - 50%, crude palm oil
- 37.5%, refined palm oil - 45%

* Sensitive list of goods with partial duty cuts - 606 items,
(Agricultural - 16, Textile - 304, Machinery & auto - 60,
chemicals & plastic - 226)

* Negative list with no duty cuts - 489 items. (Agricultural -
302, Textile - 81, Machinery & auto - 52, chemicals & plastic
- 32, Others - 22)

* Operational from Jan 1, 2009, Deal to be signed in December
2008 at Bangkok Trade Snapshot.

* Bilateral Trade (Apr-Feb 07-08) - $34.38 billion which is
9.59% of India's global trade

* Exports - $14.02 billion, Imports - $20.36 billion

The deal comes at a time when the Doha round of world trade
talks are stalled.

The India-ASEAN FTA also comes at a time when China has
already signed a similar pact with the economic bloc, as a
result of which bilateral trade between them soared to over
$171 billion last year.

A joint statement issued after a meeting of trade ministers
from India and key ASEAN members said the agreement will
facilitate the creation of an open market for 1.7 billion
people with a combined gross domestic product of $2.4
trillion.

"It took six years for India and Asean to understand the
sensitivities of each other," Indian Commerce and Trade
Minister Kamal Nath told reporters in Singapore.

The India-ASEAN pact on goods trade will result in the
signatory countries abolishing customs tariffs on 80 per
cent of goods including key raw materials like iron ore and
aluminum, plastic goods and certain kinds of machinery.

The joint statement added that negotiations for trade in
services and investment as a single undertaking will begin
as soon as possible and wind up by end-2009. "India is ready.
The onus is on ASEAN to gather its team and start
negotiations on services and investment," Singapore Trade
Minister Lin Hng Kiang said.

During the course of the FTA talks, several issues had
emerged as stumbling blocks, which included composition of
the negative list (trade items that are outside the purview
of duty cuts mandated by the pact) and tariff cuts on five
highly sensitive farm products.

In fact, India had to compromise on several of these issues
and accede to demands of nations like Vietnam, Indonesia
and Malaysia. The sticking points included reducing the
number of items in the negative list, reducing tariffs on
highly sensitive farm products as well as Rules of Origin,
norms that ensure that products from non-ASEAN countries
like China are not routed to India at zero duty under
the FTA.

Once the deal is operational - which is likely from January
2009 - the signatories to the pact will begin cutting import
tariffs in a phased manner.

Normal goods will see import duties reduced to zero over
six years, items in the sensitive list, will see partial
tariff reductions over a longer period of time.

Talks for the India-ASEAN FTA began during the National
Democratic Alliance government, with both sides initialling
a framework agreement in late 2003. It is a measure of the
importance that the current United Progressive Alliance
(UPA) government has placed on expanding India's role in
trade with the ASEAN nations that the pact has been
finalised.

The UPA had internal concerns over reducing tariffs on five
highly sensitive farm products - tea, coffee, pepper crude,
refine palm oil. In fact, UPA chairperson Sonia Gandhi and
minister of state for commerce Jairam Ramesh had last year
written to Prime Minister Singh expressing concern over the
possible adverse impact of such a move.

India is also negotiating similar bilateral free trade
agreements with ASEAN member nations like Thailand,
Malaysia and Indonesia. It already has an "early harvest"
scheme with Thailand under which duty free trade takes place
in about 82 products including automotive components.

The joint statement added that negotiations for trade in
services and investment as a single undertaking will begin
as soon as possible and wind up by end-2009. "India is ready.
The onus is on the ASEAN to gather its team and start
negotiations on services and investment," Singapore trade
minister Lin Hng Kiang said.

ASEAN secretary general Surin Pitsuwan described the
conclusion of the pact in goods as an "important milestone".
He said the move will give impetus to the stalled Doha
round of WTO talks which Asean ministers say should be
revisited.

NOTIFICATION: ISSUANCE OF HALAL CERTIFICATES BY HDC

With effect from 02 April 2008, the Government of Malaysia has
authorized the Halal Industry Development Corporation (HDC) to
issue the Malaysian Halal Certificate which was previously
issued by JAKIM (Department of Islamic Development Malaysia).

HALAL INDUSTRY DEVELOPMENT CORPORATION OR HDC

HDC is wholly-owned by the Government of Malaysia through the
Ministry of Finance. HDC was established on 18th September
2006 to fast-track Malaysia's 10-year Halal Hub project. HDC is
the world's first Halal-focused development corporation tasked
to ensure the integrated and comprehensive development of the
Halal industry.

MALAYSIAN HALAL CERTIFICATION

All matters pertaining to Malaysian Halal Certification which
was previously handled by the Halal Hub Division in JAKIM has
been undertaken by HDC. The Halal Certification Process will
still be the same and the Malaysian Halal Logo will be allowed
to be displayed and used on all HDC Halal Certificates. A total
of 52 staff from the Halal Hub Division, JAKIM which include
Syariah and Technical Auditors with more than 10 years
experience, are now being employed by HDC to ensure the
continuity of the Halal Certification Process.

HOLDERS OF EXISTING HALAL CERTIFICATES

Holders of existing Halal Certificates issued by JAKIM
(Department of Islamic Development, Malaysia) shall still be
allowed to use the Certificate, until such time the validity
period expire, as stipulated in the Certificate. After the
expiry of the validity period, only Certification by HDC is to
be accepted and recognized.

Govt Committed Towards Improving Quality Of Life of Malaysians,
Says Najib

KUALA LUMPUR Aug 29 (Bernama) -- The government remains
committed towards improving the quality of life of all
Malaysians irrespective of race or religion, said Deputy
Prime Minister Datuk Seri Najib Tun Razak.

He said the government continued to be open and had expanded
the channels of communication between the people and it and
also responded positively to concerns put forth by the people,
including the Indian community.

"It is important to tackle the specific issues of each
community and the Cabinet Committee on Indian Welfare, of
which I have been made chairman, has made progress on many
fronts", he said at the 58th Malaysian Associated Indian
Chamber of Commerce and Industry (MAICCI) Annual Dinner here
Thursday night.

He said among the progress made was the lifting of the
suspension of licences for dealing in scrap metal.

The suspension, which was to assist investigations into steel
theft had left many Indian businessmen adversely affected,
he said. With regards to the status of Tamil schools, Najib
said a task force had been formed by the Ministry of Education
to look into schools that can be given full government aid.

In addition, the government planned to train a total of
3000 youths in hair styling as well as the food and beverage
sector, areas which Indian society has been known to have a
commercial presence, he added.

He also announced the establishment of an Economics and
Business Interface Group to be chaired by MAICCI president
Datuk K.K Eswaran under the purview of the Ministry of
Human Resource.

The group will serve as a platform to channel the views on
the commercial interests of the Malaysian Indian community,
he said.

On the subject of nation building, Najib said Malaysia being
only 51 years old., had just mastered the art of walking when
others have already leapt and run.

"We are relatively a young nation compared to the United
States of America, which has celebrated 232 years of
independence and has become a world super power but Malaysia
has managed to become the envy other developing countries,
some whom gained independence a much earlier than us," he
said.

At the function, Najib also witnessed the signing of
Memorandum of Understanding between MAICCI and Indian
Hairdressing Salon Association for the provision of training
for young Indian youths.

More than 3,000 businessmen and corporate leaders attended the
dinner to mark the 58th year of the MAICCI.

PUTRAJAYA: The government, through the Human Resources
Ministry,will look into problems faced by Indian youths,
particularly school dropouts.

In a 45-minute meeting with 35 members of the Malaysian
Associated Indian Chambers of Commerce and Industry, Deputy
Prime Minister Datuk Seri Najib Razak also took note of the
issues facing the Indian community.

Describing the meeting as fruitful, chamber president
Datuk K.K. Eswaran said after the meeting at Kelab Tasik that
the Human Resources Ministry would provide short training
stints, ranging from six months to one year, for the youths.

"Already, an experienced and established hairstylist who has
over 100 outlets in India has been engaged to provide training
for the youths.

"Youths from India will be in Malaysia for about one to two
months for practical training in similar courses."

The chamber, which has about 4,000 members throughout the
country, aims to assist 500 youths to undergo training every
year.

"The ministry will also provide other forms of training for
youths interested in going into the food, hotel or catering
industry," said Eswaran.

"We want them to be professional chefs at food outlets or
restaurants, which are now being monopolised by cooks from
India.

"We also put forward a proposal to Najib for all Indian trade
bodies, including goldsmiths, tourist operators, news agency
associations, barber associations and metal traders, to be
registered and placed under the chamber.

"The problem we now face is that most of these bodies are
not registered. So, it is difficult for us to assist foreign
workers who are victimised by their employers."

He said the deputy prime minister would bring the matter up
with the cabinet.
