It's been awfully quiet lately. Apparently, no one but Goldstein
clients are going to trial in December. (And there are only a couple
of those.) Everyone is still waiting for word from Judge Vance
on "withdrawing the reference," a fancy way of saying that some cases
may be moved from the bankruptcy court to her District Court in New
Orleans.)
The Omnibus Objection by OCA, in which they state they're not going to
pay anyone, has been put on ice for the time being, with the agreement
of the secured creditors committee and some of the docs named in the
pleading. Was this an attempt on OCA's part in an effort to further
intimidate litigating docs? At least some attorneys are still unsure
what to make of it.
I've wondered if Dr. Bush might appeal his verdict. An appeals court
seldom raises the ante, but often reduces an award. The down side is
that to appeal, an appellant typically has to post a bond for 125% of
the amount awarded. (The original award, plus a reserve for legal fees
if the person doing the appeal loses again.)
If anyone hears anything, please put it on the board so we can all stay
informed.
