from IFC in violation of the Florida AG's supoena. They demand
certified funds by 5PM on September 13th. I am going to send them a
cert letter informing them of this and my knowledge of their
collusion with Norvergence in a phony scam.

We got the demand letter today also with the same cutoff date. It
says that non-payment by that date would result in no other course
other than to sue us.

Spoke with AG's office. They are being very agrressive with this.
They requested a copy of the Demand Letter in violation of the
subpoena. You need to call them in Tallahassee. Telecommunications
is a regulated industry in the state of Florida. If you bought cable
and other services with them they comitted fraud in a regulated
industry and the leasing companies should know better.
Does this mean that, at least for now, I should not
expect to receive any more bills from IFC (at least
for the time-being)?

I think anyone who sends IFC even one cent needs their head
examined. Norvergence represented themselves as agents in a
regulated industry in Florida. This was outright fraud. The leasing
company knew this. They are in collusion, end of story. No judge
will hear their cases now that the AG has intervened.
I think I was sued that way in NJ. But, if the leases are VOID in
Illinois, then what is their basis for suit since they are in
Illinois? That you unwittingly induced them to pay Norvergence big
bucks for for a $1000 matrix and prepaid services? And why weren't
they paying one year at a time? They were not even allowed to phone
you to see if the equipment was working and installed (according to
their master agreement with Norvergence). They paid on the D& A, but
as all of us know, that was presented as proof that the matrix was
dropped off, much like a UPS signature. This just keeps getting deeper
and deeper. And 11,000 small businesses all tell the same story.
The ERA clearly says "non-binding until the equipments is installed in your
phone closet"
Delivery in itself should not be equivalent to those terms.

deserves to go down. They are one of the "hardliners". I paid a year,
and have gotten statments every month for another year. When all this

until all the money and lines of credit have been used up. As long as
you are fighting small business with other peoples money why would you
stop. Their paychecks keep coming untill they shut the doors!
Investors are not going to look kindly on the court rulings that are
being handed down.
The letter to Kit looks just like Norvergence 6 months before they
went under. Hard to say what will happen but it looks the same!

After the fall of Norv, it was obvious the Salzanos & their lawyers
spent a huge effort in the prior months trying to keep a lid on the
truth - by hounding and threatening anyone who posted their opinions
and experiences with their fraudulent scheme.
IFC is in the same boat now - but the legal proceedings of the trials
are public records. All the LC's still fighting the small businesses
are going to find it hard to run from the truth. Are we to believe
that IFC was the "only" LC that got such a sweetheart holdback deal
from Norv? Yeah right.

Well this is a good day! My lease was with IFC, my business is in
Harris County Texas. Finally it looks like some action will be taken.
I (reluctantly and only upon advise of counsel) paid for a year out of
the three that they bought, but they never told me they "only" bought
three years. I found out when they sued me via Weir in New Jersey.
When that suit was filed I stopped paying and they called and asked
why I was refusing to pay. And I told them that since they sued me
anyway there wasn't any more they could do; I'd just see them in
court, and so it stands --- nothing has happened since Feb 05. A few
months ago I had to send in all of my paperwork (evidence) I still get
a statement every month, but the amount is always the same at this
point (since Feb)
I reconciled my payments and it looks like under class action
settlement they would owe me $753.58. Of course the payments were
wrong on the document I received
Leasing News has reported that as the FTC-IFC Credit, Morton Grove, Illinois bench trial moves to April 28, 2008 at 9:30 a.m. before United States District Court, Northern District of Illinois Magistrate Judge Jeffrey Cole, it has been trying to settle as many of the outstanding NorVergence leases. Meanwhile Missouri and Texas Attorneys General await the outcome.
As evidence to the thrust to settle cases before the bench trial, attorneys continue to report the move to settle cases. This is from attorney Michael J. Fleck:
“I find it curious that IFC spent years fighting for the validity of the forum selection clause to be upheld in Illinois, at considerable cost and expense to both sides, only to covertly negotiate a purported settlement in a distant forum. Further, the terms of that settlement are worse than what other leasing companies settled for years ago before protracted litigation. These terms do not consider the counterclaims that may prevail in Illinois. IFC voluntarily selected Illinois to initiate these hundreds of lawsuits. It was not forced to settle in New Jersey; it chose to settle in New Jersey, completely counter to its successful arguments that the cases belong in Illinois.
“We have spent months negotiating standing orders and protective orders to move these consolidated cases forward and not once did IFC inform the Court, the FTC or any Illinois defense counsel of the New Jersey negotiations. Apparently, IFC may be regretting its victory over the jurisdiction issue in Illinois.
“My office filed a Motion for Sanctions against IFC concerning its conduct in entering into the purported NJ Class Settlement (attached). Today, Judge Murray, who is presiding over the consolidated IFC/NorVergence cases, issued a preliminary injunction that affects this settlement (attached). This is set for additional hearing on March 27, 2008 at 1:30 PM before Judge Murray. (The hearing, however, may be postponed by IFC Credit until April. editor)

According to several sources, the group doing the audit is Phoenix something (not Phoenix Leasing Portfolio Services, Inc. out of San Rafael, California) allegedly hired by CEO Rudy Trebels, CLP to find buyers of leases/residuals, find new funding sources. In turn, Leasing News was told by a reliable source they got backing from the banks to go in and get Rudy Trebels and Mark Lang out of it, having some inside information that would not be beneficial to the two parties. Reportedly Wolfe and Co out of Oakbrook stopped doing IFC's audit at the accountant firm's decision.
There are other reports of specific leases for sale with other brokers involved, but there are questions regarding the bond holders and insurance on the leases. In the meantime, staff still at IFC Credit and the other divisions, although minimal were paid, and supposedly there is enough in the planning for an additional two weeks, but that's it. No new leases are being considered and the staff is not active, since servicing has been taken over the banks involved.
In any of the outcomes, a bankruptcy appears to be the way to satisfy unsecured creditors and get all the secured creditors to agree to a business plan.
