QUESTIONS ON WHO IS LIABLE   Message List

RE: [Tower-pro] Re: QUESTIONS ON WHO IS LIABLE

Wow. The towers were stolen. That's different than just dropped.

Even if the GC was doing work, they are not liable for someone stealing the
towers. If someone can take 2- 200ft standing towers, a little bitty lock on
a gate is not gonna stop them. What do you mean by "unattended?" Was someone
usually on site around the clock? That usually isn't a requirement so I
can't see how you or the GC is responsible for theft.

But my biggest question I have is when was this done? How long did it take?
Did it happen over a few days or a weekend or what? If the towers were due
by 12-26, they should have been down long before the Christmas holiday. Were
they delayed and came back from Christmas to find the towers gone?

And of course I have to ask if it was an inside job. Where did the aluminum
go? The towers would only be worth scrap. I'd say that would be grand theft
and the police would be able to find a lead. Hell, for that money, I'd
suggest hiring your own detective.

I would contact the crane company and see what their logs show and see about
talking to the crane operators. Does the time add up? Do you have evidence
that the towers were dropped? (I'm sure it would be obvious but I have to
ask.) If they were dropped, someone had to cut the tower up and load it onto
trucks. How remote was this site? That much cutting would have to light up
the night sky. If they used saws, they had to buy a boatload of extra
blades.

Just to ask, are you sure that the GC didn't screw up and accidentally drop
the towers and are now claiming theft?

Wow Mike you sure got some amazing stories!
