It works several ways, the one taht interestd me: you can set it to
block all faxes except those on an approved list you create. I don't
have anyone I want to receive from on a regular basis, so I'd block
them ALL until I know one is coming.

Or you all working for faxrecoverysystems or just stupid?

"I hereby certify that neither I nor my company, identified herein
below, gave the sender(s) ("Sender") of said fax(es) or to
Sender's agent any prior express or indirect invitation or permission
to transmit the cited faxes to me or my company."

I would NEVER certify that! For most faxes, I don't even know who
sent them.

"I therefore authorize Agency to bring action or suit, on behalf of
Client and to do so at Agency's sole discretion in Client's
name ..."

Over my dead body. Nobody files suit in my name unless I explicitly
authorized the suit.

Why would I subject myself to possibly hundreds of thousands of
dollars in liability? Not to mention having to fly to testify and
all that crap.

I don't understand why you hijacked MY offer to purchase my junk faxes
under MY terms to advertise faxrecoverysystems.

As I said, you either work for those morons are you're the dictionary
definition for gullible and dimwitted.

You haven't even figured out that there's a difference between getting
$10 at the time of sale (assignment) and *** MAYBE *** getting $100
sometime after who know how many hassles and successful collection?

You can discuss here whatever you want in YOUR threads and I was
really hoping to limit MY thread to MY topic:

"I will sell my faxes for $10 each"

So if anyone wants to discuss my offer - great. If not, please start
your own topic.

I hate to tell you lady, but nobody meant to steal your post.  I posted a reply asking about the Fax Recovery Systems, and for that I am sorry.  But your responses to other members of this group and your abuse of them seems highly questionable.  We are here, all looking for a solution to the never ending problem of JUNK FAXES.  We didn't come here to be insulted or called morons or the like.  That is the benefit of a group like this - to share information and learn from it, not to insult and degrade.  Now that I've made those statements, I myself am sorry if I have offended you in some way, but if you were upset by my post, you could have expressed so without insulting the other members of the group.

I don't work for them, I don't represent them, and I never have.

Personally, in any legal matter I know of, you have to assign rights to your lawyer to collect or they can't bring suit.  That's called representation.  Call me wrong if you like, but in the dictionary, that's how I interpreted it.

In all honesty, I see nothing wrong with their agreement, and my lawyer felt the same way too.  I asked the question because I was wondering if anyone else here has had success with them, not to argue their business matter, and MOST DEFINITELY NOT TO FLAME OR BASH THEIR OPERATION AS I KNOW NOTHING ABOUT IT.

Moderators of this Yahoo Group, I apologize if I have said things that crossed the line of what members can post, but I felt that this needed to be said.

As of this point, I won't bother replying to other messages for fear of sparking another dispute such as this one.

Sincerely --
J. LaDow

PS: By the original nature of your post, ma'am, it might even have been considered a SPAM posting in it's nature.  Also, the concept of assigning the faxes to someone is NO DIFFERENT that assigning them to the law firm.  What can another person do with your faxes that the law firm can or cannot do?  Nevermind -- I don't need the answer to that.

PPS:  It's a shame that the most activity this group has shown in one day has been in a slightly arguementative manner, and I've been a member since May.  Normally, I'm lucky to see a message from here more than once a week.

PPPS:  Thanks to the rest of the members and the founders of this site (junkfax.com) for all their hard work to stop these menaces that spend my hard earned office supply money on things other than what I planned on...

This is the topic: "I will sell my faxes for $10 each"

If you think it's spam, have it deleted. Better yet, sue me.

I posted this topic because I got tired of you morons talking about
faxrecoverysystems without ever reading the contract.

Now that we've discussed the contract -- OFF TOPIC because you can't
shut up -- I hope it's clear to everybody with half a brain that it's
not good idea to sign that contract.

America is a country in rapid decline and I'm on my way out. I
learned that trying to teach people how to think, how to help
themselves and how to avoid getting screwed.

I learned through my efforts that Americans are lazy, stupid, greedy,
ignorant or selfish morons -- and any combination thereof. Well, all
except for 1 in 1,000, or so.

I still feel sorry for the people who get scammed and I got this
response from an expat in Nicaragua:

"Today, I look at this stuff as "if people lose their money then they
pay less taxes which means less people get killed around the world". I
understand it is the little guy that gets suckered in but, here, the
little guy can't because he has no more money than that which might
buy rice for today. Sorta makes the whole thing look very different."

That pretty much sums it up. I still feel bad for people who get
scammed, but I'm working on putting it in a different perspective.
And if I had thought of that quote before I posted, I wouldn't have
wasted my time.

If I really thought somebody wanted to buy my faxes for $10 each, I
can just post that at my own sites where I don't have to put up with
your BS and I have a LOT more traffic.

You must run in different circles than I. The Americans I know are
friendly, generous, hard-working contributors to society. Well, all
except for 1 in a 1,000 or so. I agree that there is a lot wrong with
our society and that's a topic for another forum. But in society, as in
most things in life, you find what you look for. If you look for
stupidity, greediness and avarice, you will find it. I've found MUCH
better.

I must be coming into the middle of a conversation that started elsewhere...
How can someone be sued over an opinion, which is what - I think - was
presented? Any judge worth a hill of beans would toss that in a hurry!

> I posted this topic because I got tired of you morons talking
> about faxrecoverysystems without ever reading the contract.

Ummmm... Calling other people names will NOT encourage anyone to listen.
That is, I assume, the desired goal!?!? Insulting someone will NOT help, no
matter what kind of facts or reasoned argument that is presented. Work is
needed on people skills...

> Now that we've discussed the contract -- OFF TOPIC because

We have!?!?!? Where???? When??? Must have missed that conversation too. So,
I can't be persuaded to one side or the other on this 'argument' as I've not
heard it. Nor am I willing to listen if that consists only of name calling.
Facts, my dear, facts. So far, I haven't heard any...

Did this message get cross-posted into the wrong group!?!?

Ahhhh.... So America (the US, I guess you mean) is going down the tubes?
Interesting! What facts support this statement? People have been predicting
the fall of the US from the day we declared our independence. Hasn't
happened yet! Americans may have a lot of faults, but quitting isn't one of
them. Nothing is ever accomplished by just giving up.

If you're feelings on the topic are that sincere on the wish to leave, feel
free! Bye! Don't let the door hit you on the way out.

> I still feel sorry for the people who get scammed and I got

Huh??? We're talking about the infamous Nigerian scam messages now??? Where
someone claims they are holding millions (or trillions) of dollars and need
YOU'RE help?!!? Gee, how can anyone turn down an offer like that? ;-)

Seriously, I am quite aware of how many people are taken in by scams. The
sophistication and level of deception found within those continues to
improve all the time. As a matter of routine, I include at least one
screenshot of a new type in every issue of my newsletter I mail out to my
customers. Have heard a few 'thank-you's on that topic, which is why I
continue it.

Sorry, it seems this response is traveling through a lot of different
topics. Pardon my confusion and digression...

> If I really thought somebody wanted to buy my faxes for $10

Okay... I think we're back on topic for the junk-fax-discussion list.
Someone wants to buy someone's junk faxes for $10??? Who??? When was this
offer made??? I'd really like to know more before I commented further.

> "If people lose their money then they pay less taxes which
> means less people get killed around the world"

???? Someone said this???? In reference to what? I can buy into a statement
about bankruptcy or poverty leading to less tax money. But, how does that
connect to people getting killed? Sorry, that line of reasoning got lost in
translation...

BTW, any reason why this statement was repeated 3 times? Stating something
over and over and over does NOT make it true.

> So, this group is all yours, enjoy.

Ahhhh... The perennial favorite threat... "I'm leaving because <insert
reason here>." <*sigh*>

A group such as this gathers together out of a common goal. In this case, we
are gathered together out of a sincere desire to stop abuse of our time,
money, and resources by those who send out junk faxes. We know our efforts
in reaching that goal can be made easier by working together. Putting aside
our personal issues with each other or differences of opinion on various
topics may be required and should be expected. Let's keep our focus on the
prize to be won here, after all!

Or you all working for faxrecoverysystems or just stupid?

==== Hey, why be rude? I thought the info on Fax Recovery Systems was very interesting.  One topic leads to another, that’s the value of lists like this.

"I hereby certify that neither I nor my company, identified herein
below, gave the sender(s) ("Sender") of said fax(es) or to
Sender's agent any prior express or indirect invitation or permission
to transmit the cited faxes to me or my company."

I would NEVER certify that!  For most faxes, I don't even know who
sent them.

==== Well, if you get a fax to buy some hot stock from somebody you never heard of, isn’t that a pretty good indication that you didn’t give them permission to send it?

"I therefore authorize Agency to bring action or suit, on behalf of
Client and to do so at Agency's sole discretion in Client's
name ..."

Over my dead body.  Nobody files suit in my name unless I explicitly
authorized the suit.

==== So only send them faxes from people you definitely want to sue.  I don’t know what the point would be of you sending them a fax you got from Hot Stock Tips and then having them call you to ask, “Do you want us to sue Hot Stock Tips”?  Of course you do, that’s why you sent them the fax!

Why would I subject myself to possibly hundreds of thousands of
dollars in liability?    Not to mention having to fly to testify and
all that crap.

==== Hundreds of thousands of dollars in liability because you sued a junk faxer?  Have you ever heard of this happening?  These people are stealing paper from your fax machine.  They are violating the law.  You have a perfect right to sue them and I am not aware of anybody having to pay money to a junk faxer because you sued them.  If In the unlikely event I had to fly somewhere to testify, I just wouldn’t go.  No big deal.

As I said, you either work for those morons are you're the dictionary
definition for gullible and dimwitted.

==== Sounds like you are having a bad day.  But I think this company’s offer is far more intelligent than yours.  Sure, $10 in the hand now is worth more than a possible $100 in the future, but do you seriously think that somebody is going to pay you $10 up front for your junk faxes?  If you hear of some fool who is willing to do that, let me know, because I’ll make at least $500 a month from it.

==== LOL!  Are you the “owner” of the thread?

Mark

Hi-

I've been getting junk faxes to my home voice line from ActiveCore (or
its subsidiaries) from 1-416-621-2694. (I managed to intercept one by
forwarding it to an actual fax machine---it was an ad for sending out
junk faxes). Despite following their instructions, I can't seem to
get off their list.

If anyone else is in this predicament, you might want to go to their
investor forum at:

http://www.agoracom.com/nonmemforum/main.asp?topic=ActiveCore+Technologies

They're a publicly traded company---maybe if enough people complain,
they will take complaints more seriously.

On the other hand, if one had permission to send a fax or an EBR (and a fax
number given for the purpose of sending faxes or the fax number published in
a directory or on the internet), then one wouldn't have to waste the $ to
purchase the fax number from InfoUSA.

Ergo, it would seem that any entity that is not exempt from the TCPA that
purchases fax numbers from InfoUSA must be doing so for illegal activity...

Although I hate to waste my time, I hate the junk faxes just as much.
So lately I've decided to have some fun and hopefully make them waste
some money.

I'll call the number for Mortgage Services, loans etc... and tell them
i am interested in refinancing my mortgage. The operator, after taking
some basic information transfers my call to the company that actually
pays to have the faxes sent out. I give them a fake name, address
etc... I
tell them my house is worth about $950,000 and I have about $200,000
left on my mortage. I want to refinance and pull about $500,000 in
equity for a business I am starting. At this point, the rep is all
excited, with visions of commissions dancing through his head. I
discuss several proposals with them and then insist that they FedX me
the available options for me to review. I tell them I do not want the
proposals in email they must be in writing. 9 out of 10 times they
agree to FedX the information to me. I estimate that they will spend
anywhere between $20 and $40 to send me the information which is going
to a non-existant address. Just make sure that the zip code matches
whatever town or city you use.

I wonder how long it would take them to stop paying for junk faxes if
we all did that! It makes me feel good knowing I've wasted just a
little of their profits.

If you happen to be bored one day or a little slow a work give it a try.

I got a fax the other day and it was really low rate.  Hand written.  The guy was selling granite name markers.  It was 2 pages

I finally got an answer at the header phone number (it said it was the fax number but the answering machine wouldn't pick up as a fax)  I told the guy that sending out unsolicited faxes is against the law

He said they had researched it and it wasn't "If it is a legitimate item for sell."  I told him he better check it out again because according to the Texas codes what he sent me was illegal.

I wonder what all those other people think about a legit selling product.  Those Nicaraguan guys, and penny stock, mortgage, Drive Time,  Staffing people I guess they are not legit.

you know, getting a fedex from them with a valid return address would
give you just about everything you need to file suit against them (at
the very least, an address for a cease and desist or demand letter).
Technically, there may be some (although remotely possibly) legal
trouble you could get in for providing all the fraudulent info. Plus,
they may not realize you were referred by a junk fax. Could have been
via a spam email, a legit referral via junk mail, etc. No way to
verify that the rejection is associated with the junk fax. Cathartic?
yes. effective? probably not.

I had a run in with a company that spam-faxed our home based office.  They claimed they had every right to fax us unsolicited due to a change in some new law, but the guy couldn't tell me the law or anything about it.  After a good 10 minute arguement and a threat from my lawyer for his company to stop faxing us (we filed legal complaint, and they turned around and now we get atleast 10 a day, and not to the number the business is registered on, no -- these are to the personal line.  This jerk turned around and since we send the cease and decist, he must've gotten us on some other blaster line because they're burning it up alteast 10 faxes a day now.  I wish I knew about this new law, because I'd like to drive to Washington state and strangle this bastard.

Sorry for my language there, but this is ridiculous who these people think they are.  You would think a simple remove me would suffice, but no -- you have to threaten them, spend your own money to sue them and now there's some law that he claims gives him the right to ring our phones at 3am when our children are sleeping.  So help me he better never see me in a dark alley...

Please fill us in if you find out anything about this law, if it exists and what it entails, because at this point, I myself am out for blood against this last one we dealt with.

There is no new law that would allow him to fax to you. He is lying.

Thanks again

I am new to this list, however I have sued and won over a dozen cases
so far and have collected on almost every single one. Since I am a
licensed Private Investigator, I do have a few more tools at my
fingertips than the average person. I just received a new fax today and
it stated that it conforms to November, 2005 faxing guidelines. I have
no idea what they are talking about and have tried to research any new
laws and havent found anything new. The fax comes from New York and I
am wondering if there is some sort of new law there. Obviously I cannot
sue this company in small claims court, but could of course file a
class action suit if I wanted to. The one interesting thing I saw on
this fax is a reference to contribute to a Reputable American Charities
dedicated to helping hurricane victims. I am wondering if they think
that since they have something on there for advertising a non-profit,
if they feel that they are exempt.

Thank you sir for your quick reply.  I am going to be in contact with my lawyer then, because this insanity has to stop.  I shouldn't have to change phone numbers every week to avoid these people.  The ironic part is the business line isn't even published anywhere -- we're such a small company, we do everything through the web.  The phone line was an afterthought because it had distinctive ringing on it --

Either way, I'm glad there was no legal change, because now I'm gonna be on him like a fly on you know what --

Thank you again sir

Sincerely,

there probably is a new law that has passed, because certain idiots started taking advantage of suing people and making a decent living by doing so.....

"taking advantage" of suing people for sending out unsolicited (illegal) faxes?
There is no such thing as being able to "take advantage" of those kinds of
people. I applaud anyone, who files actions against the IDIOTS who do the
illegal faxing to begin with.
